Welcome to Focusara. These Terms of Service ("Terms") govern your access to and use of the Focusara mobile application ("App"), developed and maintained by the Focusara Team ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using Focusara, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you and the Focusara Team. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Your continued use of the App following any updates or modifications to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Description of Service

Focusara is a free Smart Focus & Digital Wellbeing Toolkit designed to help you build healthier habits, improve concentration, and track various aspects of your daily wellbeing. The App is provided at no cost and currently contains no in-app purchases.

The App provides the following features:

Focus Timer — customizable focus sessions to help you concentrate and manage your time effectively.
Habit Tracker — tools to create, monitor, and maintain daily habits and routines.
Health Tracking — record and visualize personal health metrics including water intake, weight, sleep patterns, blood pressure, heart rate, blood glucose, body temperature, and nutrition.
Breathing Exercises — guided breathing sessions to promote relaxation and reduce stress.
Daily Journal — a private journaling space to capture your thoughts, reflections, and experiences.
Statistics — visual summaries and insights derived from your tracked data.
Ambient Sounds — a library of background sounds designed to enhance focus and relaxation.

All data you enter into Focusara is stored locally on your device. The App does not require user accounts, does not transmit your personal data to external servers, and does not collect analytics or usage data.

3. User Responsibilities

When using Focusara, you agree to the following responsibilities:

Use the App only for its intended purpose of personal focus, wellbeing tracking, and self-improvement.
Ensure that any data you enter into the App is for your own personal use.
Maintain the security of your device, as all App data is stored locally and is only as secure as your device itself.
Not attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
Not use the App for any unlawful purpose or in violation of any applicable local, national, or international law.
Not attempt to interfere with or disrupt the integrity or performance of the App.
Take responsibility for backing up your own data, as we do not provide cloud backup or data recovery services.

4. Health Disclaimer

Important Health Disclaimer: Focusara is NOT a medical device and is NOT intended to diagnose, treat, cure, or prevent any disease or health condition. The health tracking features — including but not limited to water intake, weight, sleep, blood pressure, heart rate, blood glucose, body temperature, and nutrition tracking — are provided for informational and personal reference purposes only.

You should not rely on any information provided by the App as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information you have recorded in or obtained from the App.

If you are experiencing a medical emergency, call your local emergency services immediately. Focusara is not designed for emergency medical situations.

5. Intellectual Property

The App, including but not limited to its design, graphics, user interface, audio content, text, software code, and all other elements, is the intellectual property of the Focusara Team and is protected by applicable copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not permit you to:

Copy, modify, or distribute the App or any portion thereof.
Use the App's name, logo, or branding for any purpose without prior written consent.
Create derivative works based on the App.
Sublicense, lease, or rent the App to any third party.

All data you create within the App (journal entries, health records, habit data, etc.) remains your own property. We claim no ownership over your personal content.

6. Limitation of Liability

To the fullest extent permitted by applicable law, the Focusara Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or any damages arising from your use of or inability to use the App.

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Specifically, we do not warrant that:

The App will meet your specific requirements or expectations.
The App will be uninterrupted, timely, secure, or error-free.
The results obtained from the use of the App will be accurate or reliable.
Any data stored locally on your device through the App will be preserved indefinitely or protected against loss.

You acknowledge and agree that you use the App at your own risk and that you are solely responsible for any damage to your device or loss of data that results from use of the App.

7. Termination

You may stop using Focusara at any time by uninstalling the App from your device. Upon uninstallation, all locally stored data associated with the App will be permanently deleted from your device.

We reserve the right to discontinue or modify the App, or any part of it, at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and governing law.

8. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. When we make changes, we will update the "Last updated" date at the top of this page. Changes become effective immediately upon posting.

It is your responsibility to review these Terms periodically. Your continued use of the App after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you should discontinue use of the App.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the relevant jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
